If you create an account (for example, to use our training platforms like Trainerize or PushPress), you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate, current, and complete information when registering or using our services.

  • Update your information as needed to keep it accurate.

  • Respect other users; do not use the service to upload or share content that is unlawful, offensive, defamatory, or infringing on others’ rights.

HEALTH & FITNESS DISCLAIMER

  • The content and services provided by Forge Fitness (including via our website, consultation, fitness programs, nutrition advice, etc.) are for educational, informational, and wellness purposes only. They do not constitute medical advice.

  • Always seek advice from a qualified health provider regarding health/medical conditions, injuries, or concerns; do not rely solely on Forge Fitness services for diagnosis or treatment.

  • By using our services, you represent that you are physically fit and capable of participating in fitness programs, and that you do not have any health condition which would prevent you from doing so (or you have obtained medical clearance).

LIMITATION OF LIABILITY

  • To the fullest extent permitted by law, Forge Fitness and its affiliates, employees, instructors, and service providers shall not be liable for any damages (including direct, indirect, special, incidental, or consequential damages) arising out of or in connection with your use of the Site or services, even if Forge Fitness has been advised of the possibility of such damages.

  • This includes, but is not limited to, losses related to data loss, personal injury, business interruption, or financial loss.

INTELLECTUAL PROPERTY

  • All content on the Site (text, graphics, images, logos, audio, video, etc.) is the property of Forge Fitness or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

  • The Site may contain links to third-party websites or services that are not owned or controlled by Forge Fitness.

  • Forge Fitness is not responsible for the content, privacy practices, or accuracy of any third-party sites.

  • Inclusion of any link does not imply endorsement by Forge Fitness. Use of any linked site is at your own risk.

CHANGES TO TERMS

  • Forge Fitness may revise these Terms at any time. When we do, we will update the “Last Updated” date at the top of this page.

  • By continuing to use the Site or services after the Terms are changed, you agree to be bound by the revised Terms.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of New York (or whichever state Forge Fitness is legally based in), without regard to its conflicts of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in Nassau County, NY, and you consent to jurisdiction there.

SEVERABILITY & WAIVER

  • If any provision of these Terms is deemed invalid, illegal, or unenforceable in any respect by a court of competent jurisdiction, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

  • The failure of Forge Fitness to enforce any right or provision of these Terms will not be considered a waiver of those rights.

MESSAGING & COMMUNICATION (Optional)

If you opt-in to receive messages (email, SMS, etc.) from Forge Fitness about promotions, appointment reminders, or updates, you agree to receive such communications. Message and data rates may apply. You may opt out at any time by following the instructions provided in the message or contacting us.
